StVO amendment repealed - remains valid for new administrative regulation

"Due to a technicality, Federal Transport Minister, Dr. Peter Ramsauer recently declared the amendment to the Road Traffic Regulations (Highway Code) from 1 September 2009 as invalid. The new rules of conduct for cyclists are therefore invalid. With a new version not before autumn 2010 expected.

The Highway Code, adopted by the Administrative Regulation (VwV-StVO) bleibt von diesem Vorgang unberührt und weiterhin gültig. Das erklärte ein Mitarbeiter des StVO-Referats im Bundesverkehrsministerium beim Bund/Länder-Arbeitskreis Radverkehr Ende April in Bremen.

Damit bleiben für die Straßenverkehrsbehörden wesentliche Teile der Neuregelungen zum Radverkehr erhalten, die ohnehin nur in der VwV-StVO standen: z. B. kein Vorrang von baulichen Radwegen gegenüber Radfahrstreifen und Schutzstreifen, die erleichterte Freigabe von Einbahnstraßen und der Hinweis auf die „Empfehlungen für Radverkehrsanlagen"."
